ScoutOut respects the privacy of its users (“you” or “your”) and has developed this Privacy Policy to demonstrate our commitment to protecting your privacy. This Privacy Policy describes the information we collect, how that information may be used, with whom it may be shared, and your choices about such uses and disclosures.

We encourage you to read this Privacy Policy carefully when using our websites, applications, services or transacting business with us.  We may occasionally update this Privacy Policy to reflect changes in the law, our data collection and use practices, the features of our Service, corporate partnerships, and/or advances in technology, as appropriate.

By registering ScoutOut’s websites, applications or other services that require you to disclose your personal data to ScoutOut, You:

  • agree and consent to ScoutOut and/or ScoutOut Group to collect, use, disclose and/or process your personal data for the purposes as described below;
  • agree and consent to ScoutOut and/or ScoutOut Group to share and disclose your personal data with ScoutOut and/or ScoutOut Group’s third party service providers or agents (whether within or outside of Thailand) for the purposes as described below.

If you have any questions about our privacy practices, please refer to the end of this Privacy Policy for information on how to contact us.

In this Privacy Policy, the following terms shall have the respective meanings specified below unless it has been stated otherwise for those particular context:

“ScoutOut” or “We” means ScoutOut Recruitment Limited.

“ScoutOut Group” means ScoutOut and other affiliated companies.

“Service or Services” means services that are provided through any websites, job portals, mobile applications or any other services, including but not limited to, JobNOW service (jobnow.work), HR9 & HR9 Clinic service (hr9.scoutout.co & hr9-clinic.scoutout.co), JobHACK service (jobhack.co), CareerCraft service (careercraft.co), OneProfile service (oneprofile.me), software, data, content and other media by ScoutOut, our affiliates and/or partners for the benefit of our Users, Members, Employers, Jobseekers, Instructors or Visitors; provided to you either as free and/or paid services.   

“Content” means any work of authorship or information, including but not limited to, salaries, company reviews, interview reviews, instructor reviews, company photos, employer responses, job ads, employer profile, instructor profile, advertisements, career development content & courses, application forms, comments, opinions, postings, resumes, messages, text, files, images, photos, e-mail, or other materials from ScoutOut, Members, Visitors, advertisers, or other third parties made available to you through our Services. 

“Jobseekers” means Users, Members or Visitors who may be looking to apply to a job or jobs, to undertake or perform a salary check, personality test or to use any service or content related to job seeking, work or career enhancements. 

“Employers” means company, organizations, legal entities, recruiters or recruitment services who may post their own and/or customer’s job and/or employer ads through our Services.

“Instructors” means Users,  companies, organizations or legal entities who provide free and/or paid career development courses, content and training for other Users or Members.

“User”, “Users”, “You” or “Your”  means any user whether an individual, company, organization, legal entity, Jobseekers, Employers, Instructors or third party service providers who visits, uses or accesses our Services; including both registered users (“Members”) and unregistered users (“Visitors”), for any reason.

“Registration” or “Registering” means the process of consenting and disclosing your data to ScoutOut to store and disclose on the User’s behalf the data necessary to facilitate the recruitment or career development process:

  • Jobseekers data include, but not limited to, personal data, resume, profile information and application form, career development goals, course enrollment & purchase history;
  • Employers data include, but not limited to, job ads, employer ads, employer profile information. 
  • Instructors data include, but not limited to, instructor profile, career development courses, content, videos, assessment tests & Member enrollment records.

“Member” or “Members” means User,  Employer, Jobseeker or Instructor that has registered and created a ScoutOut account with a ScoutOut username and password login, telephone number login or using third party logins such as LINE, Google, LinkedIn or Facebook, for example.

Use of Personal Data

The purpose that ScoutOut collects Users’ personal data includes, but is not limited to, the following:

  • To deliver and improve our products and services;
  • For the daily management of business operation of ScoutOut;
  • To provide Users with and allow the management of a Member’s account;
  • To assist in customer support and troubleshooting issues for Users by ScoutOut representative or third-party service providers;
  • To allow ScoutOut to analyse the usage of our Services, assess the interest in products, services and/or contents, and provide a better service to Users; 
  • To facilitate the recruitment process and improve the completeness of Jobseeker’s profile; therefore the profile is more useful and chosen by employers;
  • To communicate with Users through email, postal mail, telephone, LINE chat, Facebook Messenger and/or other means through online devices about products, services and/or marketing activities that may be of interest to you either from us or other third parties;
  • To develop, display, and track content and advertising tailored to your interests on our Service and other sites, including providing our advertisements to you when you visit other sites;
  • To perform analytics on ScoutOut’s websites, mobile applications or services;
  • To verify your eligibility and deliver prizes in connection with contests and sweepstakes; to submit the evidence of prize issuances to the relevant government agency;
  • To enforce or exercise any rights in our Terms of Service, and
  • To perform functions or services as otherwise described to you at the time of collection.

We encourage you to carefully read this Privacy Policy in conjunction with our Terms of Service to fully understand the conditions under which the Service is provided; Your use of the Service implies that you agree to our Terms of Service, Privacy Policy and any other rules and policies of the specific product(s) that you use.

Collection of Personal Data

Information in ScoutOut Profile

In general, we may access, store, use, and process data or information that can identify you (“Personal Data”). This may include, but is not limited to, your first name, last name, email address, telephone number, date of birth, work profile, education profile, profile picture, resume, application forms, career development goals, course enrollment & purchase history, employer account data, job post data, ads content, financial transactions on ScoutOut and/or the prizes you won, that the User disclose to ScoutOut; and other information that does not identify you. We may access, store, use, and process this information through websites, mobile applications or other services. 

Some profile data may be public by default or can be made public by the privacy settings. ScoutOut encourages you to carefully review the privacy status and settings of your profile data before saving and to periodically review that they are in your preferred privacy status..

Member Registration with ScoutOut Login or Third Party Logins

The registration of a ScoutOut Member Account through our Services, whether with ScoutOut or Third Party Logins, such as LINE, Google, Linkedin and/or Facebook, means you are authorizing us to access, gather, parse, use and store data, including Personal Data related to the provision of the Service. When you provide the Personal Data through our Service, such Personal Data may be sent to servers or databases, located locally and/or in other countries around the world.

In addition, you can also register and sign in using Third Party Login. If you do so, you authorize ScoutOut to access, store, use and process certain account information, including but not limited to, your first name, last name, email address, telephone number, gender, date of birth, profile picture, interests, and friend list, as consented by you to disclose to ScoutOut from those account(s).

Your Choices About Data Collection

You may choose not to provide us with certain information, but that may result in you being unable to use certain features of our Service because such information may be required in order for you to register as a member; make job applications; post jobs or ads; manage candidates or applications; purchase products or services; participate in a contest, promotion, survey, or sweepstakes; ask a question; or initiate other transactions.

Your Choices About Receiving Newsletters, Notifications and Marketing Material

ScoutOut and ScoutOut Group may, from time to time, send you newsletter, notifications and marketing material, for example, jobs, products (ScoutOut and third parties), content, ads, reports and/or other events that may interest you (our User, Jobseeker, Employer, Instructor or Visitors); who have registered or consented in the Service settings to receive such information which can either be through email, postal mail, telephone, LINE chat, Facebook Messenger and/or other means through online devices; By registering or consenting, you agree to allow ScoutOut and ScoutOut Group to use your personal information and/or employer profile information for sending newsletter, notifications and marketing material to you, through any communication channels and whether ScoutOut had received any compensation for such activities or not. 

Still, You may choose to change the consent or cancel your registration to receive newsletter, notifications and marketing material by changing the consent status in your ScoutOut Account, clicking on and following the instructions in the “Unsubscribe” link within the content, clicking on “Block” in LINE chat, disabling “Messages” in Facebook Messenger or by contacting us using the information below.  

Member Registration with ScoutOut Login or Third Party Logins

Use of Technology to Collect Information

We use various technologies to collect information from your device and about your activities on our Service:

Information collected automatically

We automatically collect information from your browser or device when you visit our Service. This information could include, but is not limited to, your IP address, device ID, device type, browser type and language settings, the operating system of your device, access times, your mobile device’s geographic location while our application is actively running, and the referring website address.

Cookies and Use of Cookie Data

When you visit our Service, we may assign your device one or more cookies to facilitate access to our Service and to personalize your experience. Through the use of a cookie, we may automatically collect information, including but not limited to, your activity on our Service, such as the pages you visit, the time and date of your visits and the links you click. We (or third parties) may use the data collected to show you advertisements on ScoutOut Services or third parties websites & applications.

Users can choose to accept or decline cookies, through the preference settings in the web browsers. Furthermore, Users may choose to delete cookies and the data stored within them.

Pixel tags

We may embed pixel tags (also called web beacons or clear GIFs) on web pages, applications, ads and/or emails. These tiny, invisible graphics are used to access cookies and track user activities (such as how many times a page is viewed). We use pixel tags to measure the popularity of our features and services. Ad companies also use pixel tags to measure the number of ads displayed and their performance (such as how many people clicked on an ad).

Mobile Device IDs

If you’re using our app, we use mobile device IDs (the unique identifier assigned to a device by the manufacturer), or Advertising IDs (for iOS 6 and later), instead of cookies to recognize you. We do this to store your preferences and track your use of our app. Unlike cookies, device IDs cannot be deleted, but Advertising IDs can be reset in “Settings” on your iPhone. Ad companies also use device IDs or Advertising IDs to track your use of the app, track the number of ads displayed, measure ads performance and display ads that are more relevant to you. Analytics companies use device IDs to track information about app usage.

Information collected by third-parties for advertising purposes

We may allow service providers, advertising companies and ad networks, and other third parties to display advertisements on our Service. 

These companies may use tracking technologies, such as cookies or web beacons, to collect information about users who view or interact with their advertisements. We do not provide any non-anonymized personal data to third parties.

Content you provide while using our Service (user generated content)

We provide areas on our Service where you can voluntarily post information, content or advertisement about yourself and others and communicate with others. Such postings are governed by our Terms of Service. 

Whenever you voluntarily disclose personal data or information on publicly-viewable pages, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal data or information.

How we protect your personal data

We take numerous security measures to help safeguard your personal data from unauthorized access and disclosure to third parties that are not mentioned in “Disclosure or Transfer of Data” Section. We do this by restricting the access to our database, as appropriate, by our Users and ScoutOut authorized personnel. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not guarantee, and you should not expect, that your personal information, chats, or other communications will not be shared with third parties and/or that unauthorized persons will not be able to  access our Database. 

Users should also take care with how they handle and disclose their personal information and should avoid sending personal information through insecure email or chat. Furthermore, Members should never, for any reason, share their login information with anyone.

Disclosure or Transfer of Data

ScoutOut respects the privacy of our Users and considers Personal Data as confidential information that should not be disclosed to third parties unless explicitly consented in the following scenarios; It should be noted that ScoutOut cannot control how your data (including personal information), once shared with other Users or Employers in the Service, will be used by them:

Information Shared with Other Users

When you register as a Member of ScoutOut, your ScoutOut profile may be viewable by other users of the Service, whether by your privacy settings; or you have a direct relationship, for example – a friend in ScoutOut, or other Third Party Login such as Facebook, LINE, Linkedin and/or Google; or an indirect relationship, including but not limited to, having a common friend, being a colleague in a workplace. Other users will be able to view personal data you have disclosed to us directly or through Third Party Login account, such as your photos, any additional photos you upload, first name, last name, age, sex, approximate number of miles away, personal description, your work profile, your education profile, contents you may have created and information you have in common with the person viewing your profile, such as common Facebook friends .

Information Shared with Employers

When the User applies to a job post in the Service, the User must consent to ScoutOut to disclose and transfer your personal data to that Employer for each individual application. The Employer, for the sole purpose of recruitment, will be able to view your profile which may include, but is not limited to, your profile picture, first name, last name, address, email, telephone number, age, work profile, education profile, contents you may have created, resume, application forms and other contact information.

Information Shared with Instructors

When the User enrolls in an Instructor’s course on the Service, the User must consent to ScoutOut to disclose your personal data to that Instructor. The Instructor, for the sole purpose of career and course improvement, will be able to view your profile which may include, but is not limited to, your profile picture, first name, last name, age, work profile, education profile, contents you may have created, resume, career development course enrollments, comments,  requests and other communication data.

Information Shared through ScoutOut recruitment service

When the User creates an account, submit resumes or applies to a job post in the Service, the User consents to ScoutOut to allow ScoutOut to use, process and disclose your personal data to matched Employers and positions through ScoutOut recruitment service. Matched employers, for the sole purpose of recruitment, will be able to view your profile which may include, but is not limited to, your profile picture, first name, last name, address, email, telephone number, age, work profile, education profile, contents you may have created, resume, application forms and other contact information.

Information Shared with Third Parties Service Providers

ScoutOut may and you consent to disclose information, including, but not limited to, personal and financial data, with third parties that perform certain services on our behalf. These services may include, but is not limited to, fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, ad tracking and analytics, member screenings, supporting our Service functionality, and supporting contests, sweepstakes, surveys and other features offered through our Service. 

These service providers may have access to personal data as needed to perform their functions but are not permitted to share or use such information for any other purposes.

Other Situations

ScoutOut may disclose your information, including personal data and financial data, on other occasion as follows:

  • In response to 
    • a subpoena or similar investigative demand, a court order, 
    • a request for cooperation from a law enforcement or other government agency, 
    • as required by law, and/or
    • to establish or exercise our legal rights; to defend against legal claims; or 

In such cases, we may raise or waive any legal objection or right available to us.

  • When ScoutOut considers disclosure to be appropriate:
    • in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; 
    • to protect and defend the rights, property or safety of our company, our users, our employees, or others; 
    • to comply with applicable law or cooperate with law enforcement; and/or 
    • to enforce our Terms of Service or other agreements or policies.
  • In connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.
Aggregated and/or non-personal information

ScoutOut may collect, use and share or disclose aggregated or non-personal information we collect under any of the above circumstances. We may also share this information with third parties to develop and deliver targeted advertising on our Service and on websites or applications of third parties, and to analyze and report on advertising you see. We may combine non-personal information we collect with additional non-personal information collected from other sources. We also may share aggregated, non-personal information, or personal information in hashed, non-human readable form, with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis or other business purposes

Rights to your information

If you have a ScoutOut account, you have the ability to review and update your personal information within the Service by opening your account and going to settings. You may also contact us to get access to all your personal data or request the deletion of your account. More information about how to contact us is provided below. However, your data will be retained on the Service as is reasonable and/or necessary.

If you decide to close your account, we reserve the right to retain:

  • non-personal information,
  • any processed data associated with your account for analytical purposes, and 
  • data may not be deleted, in some cases,  as required to prevent fraud, enforce our Terms of Service, take actions we deem necessary to protect the integrity of our Service or our users, or take other actions otherwise permitted by law.

In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

Third Party Websites

There may be a number of places on our Service where you may click on a link to access other websites that do not operate under this Privacy Policy. For example, if you click on an advertisement on our Service, you may be taken to a website that we do not control. These third- party websites may independently solicit and collect information, including personal data, from you and, in some instances, provide us with information about your activities on those websites. ScoutOut recommends that you consult the privacy statements of all third-party websites you visit by clicking on the “privacy” link typically located at the bottom of the webpage you are visiting.

Translation

In the event that ScoutOut provides a translation of this Privacy Policy (“Translation”) from this Privacy Policy in the English language (“English Version”), Users understand, agree and allow ScoutOut to use the “English Version” in the main version. And in the event that there is a conflict between the “English Version” and the “Translation”,  You agree that the “English Version” shall take precedent.

Changes to this Privacy Policy

We may occasionally update this Privacy Policy to reflect changes in the law, our data collection and use practices, the features of our Service, corporate partnerships, and/or advances in technology. When we post changes to this Privacy Policy, we will revise the version number at the top of this Privacy Policy. The updated Privacy Policy will be posted on the Services under “Settings” and also on https://scoutout.net/en/privacy, and you should regularly check for the most recent version, which is the version that applies. If we make any material changes to this Privacy Policy, we will notify you of the changes by reasonable means, which could include notifications through the Services or via email. Please review the changes carefully. Your continued use of the Service following the posting of changes to this policy will mean you consent to and accept those changes. If you do not consent to such changes you may delete your account by following the instructions under “Rights to your information” Section.
